On Wednesday, December 10, 2008 held a meeting of Accreditation Commission
On Wednesday, December 10, 2008 held a meeting of Accreditation Commission regarding consideration of claims from Russian Collecting societies on management with properly (neighboring) rights on collective basis to be accredited and as a result to be authorized to realize it’s activity in the following spheres of collective management: - realization of performer’s rights to collect remuneration for commercial public use, also for radio program broadcast and transmission by cable, published in commercial purposes (Article 1326 of Civil code of the Russian Federation); - realization of producer’s rights to collect remuneration for commercial public use, also for radio program broadcast and transmission by cable, published in commercial purposes (Article 1326 of Civil code of the Russian Federation). Accreditation Commission has decided that as a result of the meeting, dated Wednesday, December 10, 2008, none of Russian Collecting societies will be accredited. Date of further Accreditation meeting will be known at a later date. Meanwhile RPA continues to collect remuneration for both producers and performers in accordance with the register of the Organization.

Date of Accreditation meeting has been postponed till Wednesday, December 10, 2008
Russian protective culture has informed about postpone of the date since Friday, December 5, 2008 till Wednesday, December 10, 2008 as regards Accreditation meeting hold by Accreditation Commission regarding consideration of claims from Russian Collecting societies on management with properly (neighboring) rights on collective basis to be accredited and as a result to be authorized to realize it’s activity in the following spheres of collective management: - realization of performer’s rights to collect remuneration for commercial public use, also for radio program broadcast and transmission by cable, published in commercial purposes (Article 1326 of Civil code of the Russian Federation); - realization of producer’s rights to collect remuneration for commercial public use, also for radio program broadcast and transmission by cable, published in commercial purposes (Article 1326 of Civil code of the Russian Federation). RPA is going to participate in the European Performance Rights Committee Meeting
In october of the current year RPA is going to participate in the European Performance Rights Committee Meeting which take place in Vienna under the aegis of IFPI London. During the meeting the complete and final 2007 results, followed by an evaluation of and discussion on the industry licensing companies` performance against the societies Key Performance Indicators will be presented. Keynote speech will begin CEO of `WARNER MUSIC GROUP` - Mr. Patrick Vien. Main case studies on how to restructure, increase and operate public performance collections in a mature market will be presented by CEO of the Netherlands` collecting society `SENA`- Mr. Hans Van Berkel and other participants of the meeting. Equal Phonographic Alliance has also been invited to take part in the European Performance Rights Committee Meeting.

RPA has signed the Bilateral Agreement on mutual representation with Polish Society of the Phonographic Industry `ZPAV`
Since October`6 of the current 2008 year Equal Phonographic Alliance (RPA) has signed the new Bilateral Agreement with Polish Collecting Society of the Phonographic Industry `ZPAV`, which represents interests of biggest phonogram (videogram) producers in Poland. ZPAV was founded in 1991 at the initiative of a group of people from the record industry, mainly to represent the interests of legitimate music producers against piracy flooding Poland at that time (estimated 95% of the total market). Today ZPAV associates nearly one hundred industry representatives (physical persons) and approximately 40 record companies (major international companies as well small, independent businesses), and in value terms accounts for over 80% of the Polish music market. ZPAV is the Polish National Group of IFPI (The International Federation of the Phonographic Industry is an organization which associates over 1,400 companies in more than 75 countries world-wide).

RPA-member has brought Eurovision Gold to Russia
The Russian Phonographic Association congratulates wholeheartedly one of its originators, the organization “SBA Production” that represents artist Dima Bilan, with a long-expected victory in the musical contest Eurovision-2008.
Dima’s performance in Belgrade proved that the quality of the Russian music, actually, reached the high European standard, and the victory of Russia at Eurovision is well-deserved beyond all doubt. Another confirmation for the said above is a record-number of countries that voted for the song “Believe”. It’s not just a victory in the musical contest for us, it’s the victory of the whole Russian music industry. We believe that, thanks to such ultimate records in Europe, the Russian image will be further on growing in the world.

RPA has participated in the Global Performance Rights Committee Meeting that took place on May 15-16 in London under the aegis of IFPI.
The international and the national experience of collecting societies regarding the execution of licence agreements, law enforcement and court practice as well as cooperation with authorities were discussed at the meeting. One of the urgent issues of the meeting was creation of a single phonogram producers international database. Besides all the other questions, the collecting societies’ activities in the light of digital technologies’ development was also touched upon. During London visit, the negotiations were conducted between RPA and PPL (Phonographic Performance Limited) concerning experiences’ exchange in the sphere of collective management. PPL is one of the major collective societies in the world that deals with the collection and distribution of remunerations (collected for broadcast and public performances) on the territory of Great Britain. PPL represents interests of more than 3500 record-companies and 47 000 performers.

RPA-representatives have taken part in the Societies Council for the Collective Management of Performers Rights (SCAPR) General Assembly).
The SCAPR General Assembly is annually held.This year it was organized on May 8-9 in Berlin.
The chief aim of SCAPR activities is the development of bilateral agreements between the organizations that represent performers’ rights around the world. The cooperation of the kind advantages the compliance with rights and economic interests of artists at home as well as abroad. At present, the Societies Council for the Collective Management of Performers Rights includes the Collective Management of Performers Rights Organizations from 31 states. RPA already has effective cooperation agreements with the majority of SCAPR members. A number of issues, including development of a model agreement for signing by collecting societies as well as creation of a single database and accounts’ model forms for users were discussed at the General Assembly. Taking into account the results of the SCAPR General Assembly, RPA-representatives agreed upon concluding new cooperation agreements with some foreign Collective Management Societies.

The 10th laureates’ award ceremony of the journalist contest “Mass media for civilized music market” took place on April 24 in the Central Actor’s House in the frames of intellectual property days.
Since 1998 the organizers of the contest have been the International Federation of Phonographic Industry (IFPI) and the informational agency InterMedia. The jurors selected 20 best works out of 600 presented.
All the nominees were given presents, discs’ collections of the company Universal Music. The honorable diplomas of the National Phonogram Producers’ Federation were presented to representatives of the editions “2M” and Billboard. Judging by the results of the contest, IFPI regional Director Igor Pozhitkov awarded Smart Money correspondent Daniil Vyazovov for the material “Space with no discs” and “Gazeta” journalist Galina Lyashenko for the article “Musical escort that leads to prison” with bronze medals. Silver discs were given to “Ren-TV” correspondent Evgenij Viskov for the material of the program “Week with Marianna Maksimova” and editors of the publishing house “Yurist” Oleg Dvoryankin and Alexander Tikhonov for the book “Russia. Intellectual property. Breakthrough into future”. And the main prizes, golden discs went to “Kommersant” journalist Ivan Buranov for the article “All the rage” and Vadim Ponomarev, the author of the weekly edition “Kompaniya”, for the material “The gist. Discs are turning”.

WARNER MUSIC INTERNATIONAL (WMI) Company and “Gramrecord firm “Nikitin” have concluded Exclusive License Agreement
One of the most important provisions of the Exclusive License Agreement is collection of remunerations for public performance of phonograms that are in the WMI catalogue but through the Russian Phonographic Association.
In conformity with the License Agreement the “Gramrecord firm “Nikitin” will manufacture discs, including new ones, from the WARNER MUSIC INTERNATIONAL catalogue and along with INO RPA collect remunerations for public performances of WMI phonograms. At present, all the necessary papers are being signed by FG “Nikitin”, WARNER MUSIC INTERNATIONAL Company and RPA. Now, WARNER MUSIC INTERNATIONAL catalogue can be used only by those who carry out payment of remunerations. The WMI catalogue includes phonograms of such world-known artists as Madonna, Arietta Franklin, Ray Charles, The Doors, Black Sabbath, Ellice Cooper and the Monkees. Euro-committee is planning to change European Union legislation about copyright and neighboring rights
The duration of neighboring rights’ protection of song- and music-compositions will be prolonged from 50 to 95 years.
EU Eternal Market Commissioner Charlie McCreevy declared: “If we don’t take any special measures, thousands of European artists that cut albums in 50-s-60-s will lose their royalties for broadcast and public performances within future 10 years”. According his words, the Euro-Committee couldn’t find any “convincing explanations” for the fact, that composers have the right for copyright protection during 70 years and artists – only 50. “It is the artist, who animates a music-composition, and the majority of us do not have any idea of who is the author of our favorite composition. Usually, we know only the performer’s name”, - underlined the Commissioner. Charlie McCreevy especially marked that the Euro-Committee’s proposal has the purpose of supporting not such great artists as Kliff Richard or Charl Aznavur but “thousands of anonymous term musicians”. The Euro-Commission proposal will be formalized in the middle 2008, and the new rules will have come into force by summer already. But still several questions remain unsettled: what will be the reaction of the Russian legislation on the changes happening in the EU? Will be the term of the neighboring rights’ protection prolonged in the RF? As it appears, the answers will be clear in the near future.
