Dear colleagues, users and Russian music market members!

In connection to the Civil code 4th part that has recently come into force some questions may appear concerning RFA collective neighboring rights management.

Notice is hereby given, that:

  1. RFA is the only legitimate representative for the RF right-holders, who once assigned their catalogues to the organization's management;
  2. All the agreements concluded between users and INO RFA are valid in concerns to right-holders - RFA-members;
  3. RFA is a member-organization as it represents full right-holders, i.e. its members (phonogram-producers and performers), on the RF territory. INO RFA produces charter-documents in accordance with the new provisions of the RF Cc part 4. However, this fact cannot stop remuneration-payment owed to right-holders.
  4. There are no legally operating organization of collective administration that represents its right-holders on the territory of Russia, except for INO RFA. The status "Non-commercial Partnership" itself does not enable the organization to collect remunerations on behalf of right-holders, who are not members of such a Non-Commercial Partnership. Thus, collective administration pseudo-organizations deceives a wide variety of people, including users of different phonogram spheres. The right for remunerations is, first of all, the right of right-holders but not various non-commercial partnerships;
  5. The 4th part of the RF Cc increase penalties for illegal use of neighboring rights objects. The RFA-right-holders will bring actions to courts and law machinery against all persons (legal entities and individuals), who outrage upon neighboring rights. The cooperation of users with pseudo-organizations of collective administration does not disoblige the users to pay remunerations to right-holders or their legal representatives.

Dear ladies and gentlemen, the right-holders will further act due to the necessity of protecting their rights either directly or through RFA. One can address to the RFA office (or directly to right-holders) for neighboring rights collective management counseling.
